1. Agreement to Terms

These Terms of Service ("Terms") govern your use of the Vouchmobile application and website (the "Service") operated by Phakama Digital("we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Description of Service

Vouch is a social accountability application that helps users set and achieve personal goals through:

  • AI-generated goal plans created from voice or text input
  • Scheduled tasks with AI-assigned proof requirements
  • Proof submission and verification (text, voice, photo, video)
  • Automated AI proof evaluation and human partner/squad review
  • Accountability partnerships and squad-based group accountability
  • AI coaching through Vouchy, progress insights, badges, and streaks
  • Social features including nudges, burns, and compliments

3. Eligibility and Account

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.

4. User Responsibilities

When using the Service, you agree to:

  • Provide accurate information and submit genuine proof of completed tasks
  • Not submit fraudulent, deceptive, manipulated, or misleading proof submissions
  • Treat accountability partners, squad members, and other users with respect
  • Not use the Service to harass, bully, or harm others
  • Comply with all applicable laws and these Terms

You acknowledge that accountability partners and squad members may approve or reject your proof submissions, and that squad mechanics such as Pact mode streak resets are product features designed to encourage group accountability — not penalties imposed directly by Phakama Digital.

5. Artificial Intelligence Disclaimer

The Service uses artificial intelligence to generate goal plans, assign proof types, evaluate proof submissions, and provide coaching through Vouchy. You acknowledge and agree that:

  • AI-generated plans, schedules, and recommendations are assistive suggestions and may contain errors or be unsuitable for your individual circumstances
  • AI proof evaluation may incorrectly accept or reject submissions
  • You remain solely responsible for your goals, health and safety decisions, and the accuracy of your proof submissions
  • Vouch is not a medical, legal, financial, or professional advisory service. Consult qualified professionals for specialized advice
  • AI outputs should not be relied upon as the sole basis for important decisions

6. Proof, Accountability, and Squad Mechanics

By using accountability and squad features, you consent to sharing your goal progress and proof submissions with designated partners and squad members. In Pact mode and similar squad features, one member's missed check-in may reset the shared squad streak. You participate in these mechanics voluntarily by joining or creating a squad.

Phakama Digital is not responsible for disputes between users regarding proof approvals, rejections, nudges, burns, or squad streak resets.

7. User Content License

You retain ownership of content you submit (including proof, voice recordings, and messages). By submitting content, you grant Phakama Digital a worldwide, non-exclusive, royalty-free license to use, store, display, reproduce, and process your content as necessary to operate and improve the Service, including processing through AI systems and sharing with your designated accountability partners and squad members.

8. Subscriptions and Payments (Vouch Pro)

Certain features require a paid subscription ("Vouch Pro"). Subscriptions are billed through the Apple App Store or Google Play Store. Payment, renewal, cancellation, and refund policies are governed by the applicable store's terms. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period through your store account settings.

New users may receive a 7-day free trial with full access. The trial does not require a payment method. After the trial, continued access to Pro features requires a paid subscription.

Indicative Vouch Pro pricing (United States, subject to change and localized by your app store):

  • Annual: approximately USD $69.99 per year
  • Monthly: approximately USD $12.99 per month
  • Weekly: approximately USD $3.99 per week (if offered)

The price shown in the app at checkout is the price that applies to your purchase. Store-localized pricing, taxes, and currency conversion may vary by region.

9. Prohibited Conduct

You may not:

  • Reverse engineer, decompile, or attempt to extract source code from the Service
  • Use automated systems to access the Service without permission
  • Upload content that is illegal, infringing, or harmful
  • Impersonate others or misrepresent your identity
  • Interfere with the security or operation of the Service

10. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct harmful to the Service or other users. You may delete your account at any time through the app Settings or by contacting us at arnold@phakama.digital.

Upon termination or account deletion, your right to use the Service ceases immediately. Your account is deactivated and your profile is anonymized without delay. Personal data is erased within 30 days, except where we are required by law to retain certain records (for example, fraud prevention, billing records maintained by the App Store or Google Play, or legal holds). 11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AI OUTPUTS WILL BE ACCURATE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PHAKAMA DIGITAL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, AI FEATURES, ACCOUNTABILITY MECHANICS, OR INTERACTIONS WITH OTHER USERS.

IN NO EVENT SHALL PHAKAMA DIGITAL'S TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO PHAKAMA DIGITAL FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED UNITED STATES DOLLARS (USD $100) IF YOU HAVE NOT PAID ANY AMOUNTS TO US.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by applicable law.

13. Governing Law

These Terms are governed by the laws of the Republic of South Africa, without regard to conflict of law principles, including the Protection of Personal Information Act (POPIA) where applicable. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Republic of South Africa, unless otherwise required by mandatory consumer protection laws in your jurisdiction.

Nothing in these Terms limits any rights you may have under mandatory consumer protection or data protection laws that apply in your country of residence and cannot be waived by contract.

14. Indemnification

You agree to indemnify, defend, and hold harmless Phakama Digital, its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service, including Vouch
  • Your content, proof submissions, or interactions with other users
  • Your violation of these Terms or applicable law
  • Any dispute between you and another user of the Service

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of such claims.

15. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated through the app or website. Continued use of the Service after changes constitutes acceptance of the updated Terms.
